The Gearinger Law Group is pleased to announce that Brian Gearinger has once again teamed up with civil rights attorney Izaak Schwaiger of the Schwaiger Law Firm, this time to represent Bay Area criminal defense attorney Tyler Smith (pictured above) in a federal civil rights lawsuit against the County of Marin and members of the Marin County District Attorney’s Office.
The San Francisco Chronicle reported on the case in a July 30 article, “Attorney accuses Marin DA of malicious prosecution after three cases dismissed.” According to the complaint, filed July 29 in the Northern District of California, Marin County prosecutors accused Smith of bribing a witness, then kept that same baseless allegation alive across three separate prosecutions, each one tossed by a judge for lack of evidence.
The ordeal cost Smith his reputation and his criminal defense career, including his standing with the State Bar. Marin County Counsel Brandon Halter, who represents the defendants, stated to a reporter for the Marin Independent Journal, “The claims in this lawsuit are baseless.”
It is the kind of case Brian felt compelled to join. He has long admired the results Izaak has secured for his clients, and was glad to help hold the District Attorney’s office accountable on Tyler’s behalf.
When asked about joining the case, Brian said: “By now, any defense counsel should realize that Izaak and I do not file baseless lawsuits.”
